In one case between two neighbors disputing the right of one party to use the other’s land based on an unrecorded easement, Mr. Wirtschafter’s clients were able to obtain a favorable settlement on the eve of trial. The settlement allowed Mr. Wirtschafter’s clients to use their neighbor’s land for a large garden.

Mr. Wirtschafter has also used his real estate experience in complex collections. In a lawsuit where a debtor failed to pay, the client asked Mr. Wirtschafter to review the file. Mr. Wirtschafter recommended that the attorney handling the case file another legal proceeding under California’s version of the Uniform Fraudulent Transfer Act, in order to obtain security over the defendant’s home. The defendant then settled for payment of $350,000 with interest over time.
